![]() Employees do not need to apply for vacation or compensatory time off for 24 and 31 December. Where the employee cannot be released from work duties due to operational/service commitments, the employee is eligible for compensatory time off within 3 months. Pursuant to Section 6 subsection 3 of the collective wage agreement for the public sectors of the German states (Tarifvertrag für den öffentlichen Dienst der Länder, TV-L), employees with wage-agreement contracts are released from work duties with full pay on 24 and 31 December, where operational/service commitments permit. A reliable stand-in must be provided for any absence, whether due to vacation or illness. Managers are requested to consult with their supervisors and take the current situation into account when planning their vacation. No further extension for the carrying over of vacation leave beyond these dates may be granted. That means that vacation leave dating back to 2020 will expire on 30 June 2022, and vacation leave from 2021 will expire on 31 December 2022. Use of the extended carryover period should only occur in the case of urgent business matters this will prevent excessive accumulation of vacation entitlements. As a result, the carryover period for vacation days accruing in 2020 will be extended by 9 months, until 30 June 2022, and those for 2021 by 3 months until 31 December 2022, to enable adequate vacation planning and processing in light of operational consideration even after the pandemic situation. On 5 May 2020, it was decided to extend the carryover period for civil servants and salaried employees to take the vacation days remaining from 2019 by a period of 15 months, until 31 December 2021. Pursuant to regulations of the Free and Hanseatic City of Hamburg vacation days could hitherto be carried over until 30 September of the following year. Employees are also required to take their available vacation leave during the calendar year, despite the current situation. Vacation leave that has already been approved may only be canceled in exceptional cases (i.e., where there is an urgent work-related interest).
